Please read these Terms of Service carefully before engaging GarudaDigiLabs. They govern our relationship and define the rights and responsibilities of both parties.
By accessing or using GarudaDigiLabs's website and services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our services.
GarudaDigiLabs provides digital services including web development, software engineering, automation tools, digital marketing, and brand design. The specific scope, timeline, and deliverables for any engagement will be defined in a separate Statement of Work (SOW) or project agreement.
Upon receipt of final payment for a project, all work product, including code, designs, and creative assets, produced by GarudaDigiLabs specifically for your project will be owned by you. GarudaDigiLabs retains the right to display the work in our portfolio unless you request otherwise in writing.
GarudaDigiLabs retains ownership of any pre-existing tools, frameworks, libraries, or methodologies used in the delivery of your project. These may be subject to open-source licenses.
Payment terms are defined in individual project agreements. Typically, projects require an upfront milestone deposit before work begins, with subsequent milestone payments due upon review approval.
Late payments may result in a temporary pause of work. Invoices not paid within 30 days of the due date may incur a late fee of 1.5% per month on the outstanding balance.
We are committed to delivering exceptional craftsmanship and transparent deliverables. If you wish to cancel an engagement: • Discovery Phase: If you cancel during the initial 7-day discovery sprint before design/code assets are produced, you receive a full refund minus nominal processing costs. • Active Milestone Sprints: For active projects, fees for completed milestones approved by the client are non-refundable. Any unearned deposit for unstarted future milestones will be refunded pro-rata within 14 business days. • Retainer / Maintenance Plans: Monthly retainers may be cancelled at any time with a 15-day written notice.
GarudaDigiLabs treats all client information as strictly confidential. We will not disclose your business data, technical architecture, or trade secrets to third parties without prior written consent.
We are pleased to execute a bilateral non-disclosure agreement (NDA) prior to receiving confidential documentation.
GarudaDigiLabs's liability to you for any cause whatsoever shall be limited to the total amount paid by you to GarudaDigiLabs for the specific project giving rise to the claim. In no event shall GarudaDigiLabs be liable for any indirect, consequential, or exemplary damages.
GarudaDigiLabs warrants that all code and deliverables will be performed in a professional manner following modern engineering best practices. We provide a complimentary 30-day post-launch warranty period to resolve any bugs or defects in the delivered scope at zero additional cost.
Either party may terminate an engagement with written notice. Upon termination and final settlement of completed work, GarudaDigiLabs will hand over 100% of all completed code, designs, and digital assets.
These Terms of Service and any contract or dispute arising out of or in connection with our services shall be governed by and construed in accordance with the laws of India. Courts located in Bengaluru, Karnataka, India shall have exclusive jurisdiction over any legal claims, disputes, or proceedings.
